29 CFR 1926.451(c)(2)(v): Fork-lifts were not be used to support scaffold platforms unless the entire platform was attached to the fork and the fork-lift was not moved horizontally while the platform is occupied: (a) Near the southwest corner of the southern warehouse on or about June 19, 2012, and at times prior thereto, the pallet platform was not attached to the fork-lift. Employees on the pallet platform, 8 feet, 8 inches from the ground, painted the exterior of the warehouse.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: (a) Near the southwest corner of the southern warehouse on or about June 19, 2012, and at times prior thereto, eye protection was not used while painting the exterior of the warehouse.
