No exit point such as a ladder was within 25-feet of their work areas nor was there any other safe method to exit the trench. The employees were exposed to entrapment and/or cave-in hazards.

On or about June 19, 2012, Cimarron Sage #2 Development Area, three employees were observed working in a trench approximately 13-feet wide, 342-feet long and 5 1/2-feet to 7-feet deep. Protection was not provided by placing and keeping the spoil pile at least 2 feet from the edge of excavation. The employees were exposed to entrapment and/or cave-in hazards.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: On or about June 19, 2012, Cimarron Sage #2 Development Area, three employees were observed working in a trench approximately 13-feet wide, 342-feet long and 5 1/2-feet to 7-feet deep. There was no competent person to check the soil and excavation at the site and no initial hazard assessment was performed. The employees were exposed to entrapment and/or cave-in hazards.

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal): On or about June 19, 2012: Cimarron Sage #2 Development Area, two employees were observed working in a trench approximately 13-feet wide, 342-feet long and 5 1/2-feet to 7-feet deep, each employee in trench was not protected from cave-ins by an adequate protective system such as a trench box. EL PASO UNDERGROUND CONSTRUCTION INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.652 (A)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 307250209, CITATION NUMBER 01, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON MAY 09, 2008, WITH RESPECT TO A WORKPLACE LOCATED AT DESERT OCOTILLO, HORIZON CITY, TX 79903.
