29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmosphere containing less than 19.5 percent oxygen) or a hazardous atmosphere existed or could reasonably be expected to exist, such as in excavations in landfill areas or excavations in areas where hazardous substances are stored nearby, the atmospheres in the excavation were not tested before employees entered excavations greater than 4 feet (1.22m) in depth: Excavation Site: On or about August 22, 2017, the employer allowed employees to operate a gas Compactor (tamper) inside the excavation without testing the atmosphere regularly. This condition exposed the employees to respiratory hazards.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: Excavation Site: On or about August 22, 2017; two employees were observed working inside the excavation at the north end 57-ft. away from the nearest egress point. The excavation was approximately 587-ft long, 18-ft. wide and 11-ft deep. This condition exposed the employees to cave-in hazards. El Paso Underground Construction was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 672418, citation number 01, item number 001 and was affirmed as a final order on February 19, 2013, with respect to a workplace located at Desert Springs Unit #1, Trans-Mountain & Northwestern Dr., North side of Highway, El Paso, TX 79912.
