29 CFR 1910.1200(g)(8):� The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift.  (This provision is applicable to construction employment by 29 CFR 1926.59.):    (a) On the roof of the Regency Tower on or about June 20, 2012, the project engineer stated there was no material safety data sheet available for employees that rolled on Sherwin Williams Tile Clad HS B60U270 paint on the newly installed guardrails.  The warning label on the container stated avoid contact with eyes and skin.

29 CFR 1910.1200(H)(1) referenced by 29 CFR 1926.59: The employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about was introduced into their work area:    (a) On the roof of the Regency Tower on or about June 20, 2012, the project engineer and employees stated they were not trained on the hazards of or how to protect themselves from the hazards of Sherwin Williams Tile Clad HS B60U270 paint.  Employees rolled the paint on the newly installed guardrails.  The warning label on the container stated avoid contact with eyes and skin.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    (a) On the roof of the Regency Tower on or about June 20, 2012, eye protection was not worn and gloves were not used while rolling on Sherwin Williams Tile Clad HS B60U270 paint onto the newly installed guardrails.  The warning label on the container stated avoid contact with eyes and skin.
