29 CFR 1910.107(c)(5): Electrical equipment, used in the spray booth, was not approved for location containing ignitable residue and or explosive vapors:    On or about May, 22, 2012, an employee working in spray booth used an electrical metal fan and an electric radio that were not rated for use in a spray booth.  Chemicals such as, but not limited to, xylene, a Category 1 flammable, were used in the spray booth.   Employees were exposed to the hazard of fire.

29 CFR 1910.134(c)(1):  In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures:      On or about May 22, 2012, the employer did not implement a respiratory protection program, including procedures for selecting respirators for use in the workplace, medical evaluations, fit testing, procedures for cleaning, maintaining and storing respirators, training of employees on proper use of respirator, and evaluating the effectiveness of the program, for an employee working in the paint booth who was required to wear a half-face elastomeric respirator.  The employee was exposed to the hazard of chemical exposure.
