29 CFR 1926.403(b)(1)(i): Safety of equipment was not determined on the basis of suitability of the equipment for an identified purpose as evidenced by listing, labeling, or certification for that identified purpose. Construction site: On or about June 18, 2012, employees were operating electrical power tools plugged into a makeshift electrical Handy Box. The handy box, made out of indoor electrical equipment intended for permanent installation was not suitable for the identified purpose as evidenced by listing, labeling, or certification of the electrical equipment. This condition exposed the employees to potential shock and/or electrocution.

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: Construction site: On or about June 18, 2012, in front the house, employees were using a makeshift electrical Handy Box with an extension cord attached as the main outlet. The extension cord had the ground pin removed. This condition exposed the employees to potential shock and/or electrocution.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b). Construction site: On or about June 18, 2012, three employees observed working on the edges of two separate roofs without any form of fall protection. a) House #6544: One employee working on the backside of the house was at the edge of the roof without any form of fall protection. b) House #6540: Two employees working in front of the house were standing on the edges of the roof without any form of fall protection. REYES CONSTRUCTION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 29 CFR 1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313501066, CITATION NUMBER 01, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 12, 2011, WITH RESPECT TO A WORKPLACE LOCATED AT 11305 LOMA DE PAZ, EL PASO TX 79936.
