29 CFR 1910.178(m)(2): Employees stood under or passed under the elevated portion of a powered industrial truck: (a) Warehouse, Mounting Area - In order to mount large diameter (73-inch) solid rubber tires, weighing between 4,800 pounds to 4,900 pounds, an employee lifted a tire with a Mitsubishi forklift, model FGC 45K-LP-C, serial number AF87A20259, and positioned the tire over the bed of the Champion Industrial Press, serial number 2106, while a second employee leaned under the elevated tire to place a metal cage, used in the mounting process, on the bed of the press in order to center this cage under the tire, exposing the employee who placed the cage onto the bed of the press to a struck-by hazard from the tire elevated on the forks of the forklift, on or about June 14, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1910.178(o)(2): Loads were being handled which exceeded the rated capacity of the industrial trucks: (a) Warehouse, Mounting Area - Employees used a Caterpillar forklift, model GC25, serial number 4EM03890, equipped with a Cascade Custom Engineered lift truck clamp attachment, catalog number 50D-CS, serial number 20196-000LP, to lift large diameter (73-inch diameter) solid rubber tires. These tires weighed between 4,800 pounds to 4,900 pounds, and the Caterpillar forklift equipped with the clamp attachment had a lifting capacity of 4,700 pounds. The tires exceeded the lifting capacity of the forklift, creating a tipping hazard, on or about June 14, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1910.178(q)(6): Industrial trucks were altered so that the relative positions of the various parts were different from what they were when originally received from the manufacturer, or they were altered either by the addition of extra parts not provided by the manufacturer or by the elimination of parts. Additional counterweighting of fork trucks was done without being approved by the truck manufacturer: (a) Warehouse, Mounting Area - Employees used a Caterpillar forklift, model GC25, serial number 4EM03890, equipped with a Cascade Custom Engineered lift truck clamp attachment, catalog number 50D-CS, serial number 20196-000LP, to lift large diameter (73-inch diameter) solid rubber tires. This forklift had a homemade counterweight chained to the rear of the truck to keep the rear of the truck from lifting off the floor when employees used the truck to lift the large diameter tires. The employer did not have approval from the forklift manufacturer to use the homemade counterweight, on or about June 14, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.
