29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Worksite: The extension ladders that were used to gain access to the roof at heights of up to approximately 27 feet above the ground did not have their side rails extended 3 feet above the landing surface.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. Worksite: The employees who were working on the 8 in 12 pitch roof with an eave height of approximately 25 feet 6 inches above the ground were not protected from fall hazards by the use guardrails, safety nets or personal fall arrest systems. Diamond, Inc. was previously cited for a violation of an equivalent occupational safety and health standard 29 CFR 1926.501(b)(11) which was contained in OSHA inspection number 311782510, citation number 1, item number 4, issued on 12/3/2009 with respect to a workplace located at 115 Spencer St., Winsted, CT and became a final order on 12/21/2009.
