29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a)  Intersection of Brierhill Rd and Split Rail Ct, Berlin, NJ - Employees were not aware of the hazards of entering excavations without proper protection; when ladders are required to be used when acessing excavations; proper wear of respiratory protection; proper techniques for cutting concrete pipe; on or about 06/22/12.              NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS      REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the walls of the excavation were nearly vertical:    a)  Intersection of Brierhill Rd and Split Rail Ct, Berlin, NJ - Employee was working in the bottom of the approximate 5'7" deep excavation having nearly vertical walls and measuring approximately 13' x 13', on or about 06/22/12.         NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS      REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures:    a)  Intersection of Brierhill Rd and Split Rail Ct, Berlin, NJ -  Employees were working in and around an excavation with nearly vertical walls measuring approximately 13' x 13' x 5'7" deep without any protection against the possible collapse of the walls, on or about 06/22/12; soil at the bottom of north wall was sluffing off at the bottom of the excavation.          NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
