29 CFR 1910.1030(c)(1)(i): Each employer having an employee(s) with occupational exposure as defined by paragraph (b) of this section shall establish a written Exposure Control Plan designed to eliminate or minimize employee exposure. On or about June 26, 2012, the employer did not develop a written exposure control plan for the employees exposed blood borne pathogens including, but not limited to, Hepatitis B and C, HIV, and other infectious diseases while cleaning rest rooms and other public places in the mall. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employees' exposure to blood borne pathogens are minimized and/or reduced.

29 CFR 1910.151(b): In the absence of an infirmary, clinic, or hospital in near proximity to the workplace which is used for the treatment of all injured employees, a person or persons shall be adequately trained to render first aid. Adequate first aid supplies shall be readily available. On or about June 26, 2012, the employer did not provide first aid supplies in the break room to the employees required to perform cleaning operations at the facility. Employees are required to call the security provider for first aid supplies, exposing the employees to possible infections. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that first aid supplies are provided to the employees.
