OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard. On or about February 18, 2016, employees were required to operate a Kawasaki Mule 620 utility vehicle to service the baseball and softball fields on the University of Texas campus. The utility vehicle was not designed by the manufacturer with the required safety features to be operated on a public roadway. The operator was struck by a motor vehicle and sustained severe injuries. Employees were exposed to a struck-by hazard.
