29 CFR 1926.651(j)(2):     Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    On or about June 20, 2012 and times prior there to, an employee of FHH Construction, LLC was observed performing work tasks inside of an 8 feet deep trench located on Donovan-Briley Blvd.  The employee performed tasks such as but not limited to hand digging to locate existing water pipe for removal.  A spoil pile had been located less than 2 feet from the trench opening, exposing the employee to overhead hazards in the event rock and soil had fallen or rolled into the trench.

29 CFR 1926.651(c)(2):     A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    On or about June 20, 2012 and times prior there to, an employee of FHH Construction, LLC was observed performing work tasks inside of an 8 feet deep trench located on Donovan-Briley Boulevard.  The employee performed tasks such as but not limited to hand digging to locate existing water pipe for removal.  No ladder or other means of access and egress had been provided for employee use.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the employer had not sloped the trench or used an alternative option as provided in the standard.    On or about June 20, 2012 and times prior there to, an employee of FHH Construction, LLC was observed performing work tasks inside of an 8 feet deep trench located on Donovan-Briley Boulevard.  The employee performed tasks such as but not limited to hand digging to locate existing water pipe for removal.  No protective system such as but not limited to sloping, benching, or a trench box had been used to protect the employee from potential cave-in hazards.
