29 CFR 1926.451(b)(3): Where guardrails were not installed along the front edge of the platform or all employees were not protected from falling with the use of personal fall arrest systems, the front edge of the scaffold platform was more than 14 inches away from the surface of the poured concrete wall that material was being applied to. On or about December 12, 2012 and times prior thereto on the job site located at 1000 Donovan Briley Boulevard in North Little Rock, Arkansas, employees were exposed to fall hazards while working from a scaffold platform supported by a Volvo Excavator. The platform was not equipped with a guardrail on its front edge and the employee was not using a fall arrest system.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: On or about December 12, 2012 and times prior thereto at the construction site located at 1000 Donovan Briley Boulevard in North Little Rock, Arkansas, a Volvo EC 290 Excavator was used to support a wooden job-made scaffold platform. The owners manual for the equipment does not list it as designed for such use.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: On or about December 12, 2012 and times prior thereto at the construction site located at 1000 Donovan Briley Boulevard in North Little Rock, Arkansas, employees working in a trench approximately 58 inches deep were not provided a safe means of egress. Employees entered and exited the trench by climbing up the earthen wall. FHH Construction, LLC was previously cited for a violation of this occupational safety and health standard [1926.651(c)(2)] which was contained in OSHA inspection number 494538, citation number 1, item 2 and was affirmed as a final order on July 24, 2012 with respect to a workplace located at Donovan Briley Boulevard in North Little Rock, Arkansas.
