OSH ACT of 1970 Section (5)(a)(1):   The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while being elevated by the boom and bucket of a construction excavator.    On project site #3 of the Fishing Creek Improvement Project, Fishing Creek, Bloomsburg, PA:    a) An employee was lifted by the boom and bucket of a Takeuchi excavator and worked on an attached pneumatic drill while elevated twelve (12) feet above ground level over rocks and water;    b) An employee was lifted by the boom and bucket of a Takeuchi excavator and worked on an attached pneumatic drill   while elevated eight (8) feet above ground level over rocks and water; and    c) An employee was lifted by the boom and bucket of a construction excavator and worked on an attached pneumatic drill while elevated eight (8) feet above ground level over rocks and water.    These practices exposed the employee to a serious fall hazard while being elevated in the bucket of a construction excavator, reported on or about 07/02/12.    Abatement certification required.

29 CFR 1926.100(a):   Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.    a) On project site #3 of the Fishing Creek Improvement Project, Fishing Creek, Bloomsburg, PA, employees were working in several areas that were underneath the raised bucket of an excavator. This practice exposed each employee to a possible head injury from impact or falling objects, on or about 07/02/12.    Abatement certification required.

29 CFR 1926.50(c):   In the absence of an infirmary, clinic, hospital, or physician, that is reasonably accessible in terms of time and distance to the worksite, which is available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, was not available at the worksite to render first aid.    a) Back Branch Road - Employees working on a creek improvement project in a rural area did not have a person on site with a current first aid card to provide aid in case of an emergency, reportedon or about 07/02/2012.    Abatement certification required.
