OSH ACT of 1970 Section (5)(a)(1):   The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while being elevated by the boom and bucket of a construction excavator.    On project site #3 of the Fishing Creek Improvement Project, Fishing Creek, Bloomsburg, PA:    a) An employee was lifted by the boom and bucket of a Takeuchi excavator and worked on an attached pneumatic drill while elevated twelve (12) feet above ground level over rocks and water;    b) An employee was lifted by the boom and bucket of a Takeuchi excavator and worked on an attached pneumatic drill   while elevated eight (8) feet above ground level over rocks and water; and    c) An employee was lifted by the boom and bucket of a construction excavator and worked on an attached pneumatic drill while elevated eight (8) feet above ground level over rocks and water.    These practices exposed the employee to a serious fall hazard while being elevated in the bucket of a construction excavator, reported on or about 07/02/12.    Abatement certification required.
