OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard. a. Service Bay- On or about 7/3/2012, employees were operating the following: 1) Alignment lifts (#2 and #3) 2) in ground limited height lifts (#8 and #9) 3) two post swing arm lifts (#6 AAMCO model#- AC212S, #4 and #7 AAMCO model#- AC21NS, #5 Challenger model#-30000), which did not have an annual inspection performed on them by a qualified person.

Office- Two helium cylinders were stored in the front office without the removable caps being affixed to the cylinders when not in use. NATIONAL TIRE AND BATTERY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314107012, CITATION NUMBER 1 INTEM NUMBER 4A, WITH A FINAL ORDER DATE OF 05/25/2012, WITH RESPECT TO A WORKPLACE LOCATED AT 2400 SOUTH PARK RD., BETHEL PARK, PA 15102.
