29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    a) Second floor of building - On or about 26 June, 2012 - Employees were installing floor joists on the second floor of the building and the windows and open exterior walls did not have any guarding and the employees were not wearing personal fall protection systems to prevent employees from falling. Employees were exposed to a fall hazard of approximately 15 feet.     MARK SEAVEY CONSTRUCTION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 1926.501(b)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 281788 CITATION NUMBER 01, ITEM NUMBER 001, AND WAS AFFIRMED AS A FINAL ORDER ON 6/22/2012.
