29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): Carlos Perez Construction, at 7700 Baseline Road, Boulder, CO: On 6/22/12, Carlos Perez Construction did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them). Employees of Carlos Perez Construction were performing framing work in the construction of a new multistory fire station. Employees were exposed to multiple fall hazards. Carlos Perez Construction did not maintain a safety program which included frequent and regular inspections of the jobsite. This condition exposed employees to fall hazards of twelve feet and nine feet.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system: Carlos Perez Construction, at 7700 Baseline Road, Boulder, CO: On 6/22/12, Carlos Perez Construction did not ensure that each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system. Employees of Carlos Perez Construction were installing decking on the second story roof of the fire station. Carlos Perez Construction did not ensure that the employees were protected from fall hazards through the use of guardrail systems or personal fall arrest systems. This condition exposed employees to fall hazards of twelve feet and nine feet.
