29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder���s length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigied support that will not deflect, and/or a grasping device was not provided to assist emmployees in mounting and dismounting the ladder. On July 11, 2012 employees were using an extension ladder that did not extend three feet past the roof they were accessing, exposing then to a fall hazard of over 25 feet. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b) Note: If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502. On July 11, 2012, an employee was not protected from a fall while roofing a residential property, exposing him to a fall hazard of over 25 feet above grade. Bryja Remodeling, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in inspection number 313933004, citation number 1, item number 1, and was affirmed as a final order on March 16, 2010, with respect to a work place located at 1341 N. Bell Chicago, IL. 60622. Bryja Remodeling, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in inspection number 313621807, citation number 1, item number 2, and was affirmed as a final order on August 18, 2009, with respect to a work place located at 1617 Lake Ave. Wilmette, IL. 60091. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
