29 CFR 1926.601(b)(6): Haulage vehicle(s) were not equipped with a cab shield and/or canopy adequate to protect the operator from shifting or falling materials: At the project site, on or about July 12, 2012, and at times prior thereto, the 1992 Kenworth T800 dump truck, license number 241 CV, did not have an adequate cab shield and/or canopy to protect the operator from shifting or falling materials. The operator remained in the cab while an excavator loaded spoil onto the bed.

29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage which could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. At the project site, on or about July 12, 2012, and at times prior thereto, the tire (drivers side, rear, outer) of the 1992 Kenworth T800, license number 241 CV, was damaged.
