29 CFR 1910.147(c)(1):     Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    The employer failed to develop and implement a written lockout and tag out program.  This was most recently evident during the inspection of the facility located at 2400 South Folsom Ct. Lincoln, NE 68522, where the employer has employees performing maintenance on equipment that require lockout and tag out in order to safely work on it without having had developed a written program that outlines the principles, procedures and methods of safely performing lockout and/or tag out.  Instances include but are not limited to:    i.  The shop supervisor performing maintenance on the Wells horizontal band saw, model # B25-2, serial # A-962-R-7771 without applying a lock to the power switch to prevent accidental startup of the equipment.    ii.  Employees operating the Wells horizontal band saw, model F-1630-3, serial # A2994F05632 without having had any familiarization training on the application of lockout and/or tag out when equipment is in maintenance either by company employees or outside contractors.    iii.  Employer failure to have a written agreement with any outside contractors when they work on the companys equipment.

29 CFR 1910.147(d)(4)(i):     Lockout or tagout devices shall be affixed to each energy isolating device by authorized employees.    The employer failed to protect employees from potential amputation and electrical hazards associated with performing maintenance of equipment without applying necessary locks or tags.  This was most recently evident during the inspection of the facility located at 2400 South Folsom Ct. Lincoln, NE 68522, where the employer has employees performing maintenance on equipment that require lockout and tag out in order to safely work on it without having applied a lock to prevent the inadvertent startup of equipment.  Instances include but are not limited to:    i.  The shop supervisor performing maintenance on the Wells horizontal band saw, model # B25-2, serial # A-962-R-7771 without applying a lock to the power switch to prevent accidental startup of the equipment.

29 CFR 1910.1200(e)(1):     Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    The employer failed to develop a written HAZCOM program.  This was most evident during the inspection of the facility located at 2400 South Folsom Ct. Lincoln, NE 68522 where the employer has employees using Tru-Blue Cutting Fluid as a lubricant during steel cutting procedures to prevent binding and cool the cutting surface.
