OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not protected from fall and struck-by hazards:    a)  On or about July 13, 2012 and at times prior, employees setting and picking up cones from a platform on a barricade truck were not effectievely protected from falls and/or struck-by hazards where the guardrail system on the rear of this truck was not adequate to effectively prevent employees from falling from the truck.  The top rail of this guardrail system was 22.5 inches from the platform and there was no midrail in the system.    Among other methods, one feasible and acceptable method of abatement to correct this hazardous condition would be to design and install a guardrail system (s) that are in accordance with the Best Practices for Cone Setting Operations, as agreed upon by OSHA and the American Traffic Safety Services Association (ATSSA).  Another method would be to utilize a restraint system to prevent an employee from falling from the truck.
