29 CFR 1910.134(d)(1)(iii):     The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (Construction Reference 1926.103)    (a) The employer did not identify and evaluate the respiratory hazards associated with respirable dust containing silica generated by employees while grinding and sanding paint overspray from concrete floors and walls inside of a battalion barracks.    ABATEMENT CERTIFICATION IS REQUIRED     NOTE: Analysis of bulk samples of dust taken from the work room floor showed the presence of silica at 30%.      To comply, the employer must identify the hazardous chemical to which employees are exposed, evaluate the hazard(s) of that chemical, and finally estimate or measure employee exposures to the hazard(s). Personal monitoring is the most accurate way of obtaining worker exposure information. You can also estimate exposures by monitoring fixed locations or by sampling for short time durations. If you do this, you should measue under worst case conditioins to be sure you are providing adequate protection for your employees. Data may be available to you from previous exposure measurements. For example, studies may have been conducted in your industry. Your trade association may have data, or, manufacturers of products or materials used in your workplace may have conducted lab tests that provide worker exposure data.

29 CFR 1910.134(g)(1)(i)(A):     Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: (Construction Reference 1926.103)      (a)  An employee who was required to wear a disposable filtering facepiece respirator while sanding and grinding paint from concrete surfaces inside of a military barrack had a growth of beard that came between the sealing surface of the facepiece and the face.
