29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: (a) In front of 6621 Woodson, Kansas City, MO 64133; (1) An employee was not protected by a protective helmet while trimming trees where there was a possible danger of head injury from impact, or from falling or flying objects. The employee was standing in the elevated bucket of a track-hoe using a chain saw to trim back tree branches. Abatement certification is required for this item use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1926.602(c)(1)(vii): Unauthorized persons were allowed to ride on a powered industrial truck: (a) On or about July 11, 2012, at the Blue Nile Contractors construction site located at 6621 Woodson, Kansas City, Missouri, an unauthorized person was allowed to ride in the bucket and trim trees from the bucket of a John Deere 160 LC. The employee was exposed to being struck by branches, caught between tree limbs and the bucket, and was exposed to fall hazards while in the bucket. Abated during inspection. Abatement certification for this violation is not required.
