29 CFR 1926.20(b)(2): 29 CFR 1926.20 (b)(2) The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer. a) 407 Monmouth Road, North Hanover, NJ: The employer did not provide frequent and regular inspection by a competent person to recognize and address hazards of the job site. The employees were preforming roofing activity on a residential home and working from heights ranging from greater than 9.5 feet to 19.7 feet from the ground level, observed on or about 7/17/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): 29 CFR 1926.501 (b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system. a) 407 Monmouth Road, North Hanover, NJ: The employees were performing roofing activities such as but not limited to removing the old roof, preparing the area, and then re-applying a new roof without the use of fall protection, from heights ranging from greater than 9.5 feet to 19.7 feet from the ground level, observed on or about 7/17/12. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
