29 CFR 1910.178(p)(1): Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition. At the job site, 402 Miller Drive, Wamego, Kansas, employees were operating the large caterpillar forklift with a horn that did not work. The forklift was not taken out of service. Employees were exposed to struck-by hazards.

29 CFR 1910.184(h)(5)(i): Natural or synthetic fiber rope sling(s) with abnormal wear were not immediately removed from service: At the job site, 402 Miller Drive, Wamego, Kansas, employees in the fabrication/welding department were using synthetic slings that were frayed, discolored, and cut. Employees exposed to struck-by hazards from defective slings.

29 CFR 1910.243(c)(3): Vertical portable grinders. Safety guards used on machines known as right angle head or vertical portable grinders shall have a maximum exposure angle of 180 deg., and the guard shall be so located so as to be between the operator and the wheel during use. Adjustment of guard shall be such that pieces of an accidentally broken wheel will be deflected away from the operator. At the job site, 402 Miller Dr. Wamego, Kansas, employees were operating hand held grinders without the wheel guard in place. Employees were exposed to struck-by and cut injuries.
