29 CFR 1910.95(b)(1): Employees were exposed to sound levels exceeding those listed in Table G-16 of the Subpart G of 29 CFR 1910 and feasible administrative or engineering controls were not utilized to reduce sound levels: a) Super Stud Building Products, Inc./Edison, NJ site - Production Room: The employer failed to provide feasible administrative or engineering controls to reduce noise levels in the production area, where employees are exposed to continuous noise levels of: 93.87 dBA (machine operator #3, F Line), 92.64 dBA (for machine operator #5, G Line), and 92.98 dBA (for machine operator #6, P Line), which is equivalent to doses of 171.10%, 144.30%, and 151.20% respectively. These levels exceed OSHA Permissible Exposure Limit (PEL) of 90 dBA. Sampling time was 448 minutes, 434 minutes, and 433 minutes respectively. Zero exposures were assumed for all unsampled time periods. Condition observed on or about July 23, 2012.

29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program, as described in 29 CFR 1910.95 (c) through (n) was not instituted, when employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels: a) Super Stud Building Products, Inc./Edison, NJ site - Production Room: The employer did not provide a continuing effective Hearing Conservation Program for employees exposed to noise levels above 85 dBA. Employees working in the production area were exposed to continuous noise levels of : 87.31 dBA (machine operator #1, P Line), 89.17dBA (for machine operator #2, P Line), 94.60 dBA (for machine operator #3, F Line), 88.95 dBA (machine operator #4, F Line), 93.30 dBA (for machine operator #5, G Line), and 89.6293.60 dBA (for machine operator #6, P Line) for an 8-hour TWA, , which is equivalent to doses of 68.94%, 89.20%, 190.20%, 86.88%, 158.70% and 164.80% respectively. These levels exceeded OSHA Action Level of 85 dBA. Sampling time was 452 minutes, 454 minutes, 448 minutes, 447 minutes, 434 minutes, and 433 minutes respectively.
