29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:          a) On or about 7/23/12, on jobsite at 2609 Bailey Ave., Buffalo, NY: Employee was exposed to fall hazards and potential eye injuries while doing roofing & framing work, and using powered handheld tools such as but not limited to a staple gun. No training about the Osha fall protection standards and personal protective equipment standards was provided.    ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(15):     Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system:      a) On or about 7/23/12, on jobsite at 2609 Bailey Ave., Buffalo, NY: Two stacks of plywood sheets (approx. 5 sheets in each pile) were placed lengthwise & perpendicular onto the forks of a Gradall, Model G6 42P Rough Terrain Forklift Truck (Telehandler). An employee stood on the outermost stack of plywood, the forks were raised, and the employee was exposed to a fall of approx. 17 ft. while using a staple gun to install plywood on the northwest corner of the roof. There was no safety platform secured to the mast/forks and no other fall protection system was used.      NO ABATEMENT CERTIFICATION REQUIRED
