The gate/railing installed functions like a swinging gate, which does not secure in place to rigidly guard the open side.

29 CFR 1910.157(e)(3): Portable fire extinguishers were not subjected to an annual maintenance check and/or the annual maintenance date was not recorded, retained for one year, and available to the Secretary of Labor upon request:     Instance 1: On or about 07/26/2012, on the Yale Veracitor 50VX forklift (serial # F856033) in the Drive-through, the employer did not ensure that the fire extinguisher was subjected to an annual maintenance check and the annual maintenance date was recorded and retained.  Part of the inspection tag was broken off such that the most recent maintenance date was not available.          Instance 2: On or about 07/26/2012, on the Caterpillar forklift (model # GP40K1, serial # AT29C00512) in the Drive-through, the employer did not ensure that the fire extinguisher was subjected to an annual maintenance check.  The inspection tag denoted that the last annual maintenance check was performed on March 28, 2011.     Instance 3: On or about 07/26/2012, on the storage rack adjacent to the exit door on the west wall of the Drive-through, the employer failed to ensure that the fire extinguisher was subjected to an annual maintenance check.  The inspection tag denoted that the last annual maintenance check was performed on April 5, 2011.     Instance 4: On or about 07/26/2012, on the Mitsubishi forklift (model # FGC25K, serial # AF82C-03462) in the Drive-through, the employer did not ensure that the fire extinguisher was subjected to an annual maintenance check.  The inspection tag denoted that the last annual maintenance check was performed on March 28, 2011.     Instance 5: On or about 07/26/2012, on the storage rack between B and Backside B in the Drive-through, the employer failed to ensure that the fire extinguisher was subjected to an annual maintenance check.  The inspection tag denoted that the last annual maintenance check was performed on March 28, 2011.     Instance 6: On or about 07/26/2012, adjacent to the overhead door on the north wall of Appliances (Yard), the employer failed to ensure that the fire extinguisher was subjected to an annual maintenance check.  The inspection tag denoted that the last annual maintenance check was performed on March 28, 2011.     Instance 7: On or about 07/26/2012, on the east wall of Vendor Return (VRO/Store), the employer failed to ensure that the fire extinguisher was subjected to an annual maintenance check.  The inspection tag denoted that the last annual maintenance check was performed in February 2010.

29 CFR 1910.176(b): Storage of material created a hazard:     On or about 07/26/2012, adjacent to the exit door north of the Mezzanine area in the Drive-through, the employer failed to ensure that multiple pieces of lumber stored vertically were secured against displacement.  The rope, hook, and eyelet configurations installed on opposite sides of both storage platforms did not provide effective means to secure 14' long pieces of lumber in place and were broken; the rope was tied to one of the platform's side supports, was to be stretched laterally across the lower portion of the lumber, and hooked into an eyelet affixed to the other side of the platform.

29 CFR 1910.37(b)(6): Each exit sign was not illuminated to a surface value of at least five foot-candles (54 lux) by a reliable light source and distinctive in color:    On or about 07/26/2012, in the southeast corner of the Drive-through, the employer did not ensure that the exit sign was illuminated.  The sign, which was positioned above the exit door on the south wall, was made of paper and had the word "EXIT" printed on it in red.
