29 CFR 1910.1001(j)(4)(i):     The employer did not attach labels or post signs, required by 29 CFR 1910.1001(j)(4)(i), for previously installed ACM and/or PACM in areas where they would clearly be noticed by employees who were likely to be exposed:    Site: 50 Park Plaza, Boston, MA  The employer did not attach labels to or use other effective posting for presumed asbestos-containing pipe insulation in the chases.  Employees are exposed to asbestos-containing insulation on pipes in chases when asked to perform such activities as repairing broken electrical splices, repairing and isolating water fixtures, and baiting the areas for roaches and mice.

29 CFR 1910.1001(j)(7)(iv):     The employer did not provide, at no cost to employee(s) who perform housekeeping operations in an area that contains ACM or PACM, an asbestos awareness training course, which shall at a minimum contain the following elements:  health effects of asbestos, locations of ACM and PACM in the building/facility, recognition of ACM and PACM damage and deterioration, requirements in this standard relating to housekeeping, and proper response to fiber release episodes, to all employee(s) who perform housekeeping work in areas where ACM and/or PACM was present, at least annually for each employee.      Site: 50 Park Plaza, Boston, MA  Employees who worked on or around PACM-insulated pipes in pipe chases behind walls and above suspended ceilings were not provided asbestos awareness training.  Some of the activities performed include repairing broken elctrical splices, repairing and isolating water fixtures, and baiting the areas for roaches and mice.

29 CFR 1910.1200(e)(1):     The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h), pertaining to labels and other types of warning, material safety data sheets, and employee information and training, will be met    Site:  50 Park Plaza, Boston, MA.    The employer did not develop a written hazard communication program, outlining the steps the employer will take to educate his/her employees and inform them of the hazards of the chemicals to which they are being exposed through proper labeling, provision of MSDSs, and formal education and training. Examples of hazardous chemicals used at the facility are Nalco Boiler and Cooling Tower Water Treamtment chemicals, and cleaners/disinfectants used by Housekeeping.
