The employer did not conduct refresher training and re-evaluate these operators after operating the forklifts unsafely. 29 CFR 1910.178(m)(5)(iii): Powered industrial truck(s), with the operator dismounted and within 25 feet of the truck still in his view, the load engaging means were not fully lowered, controls neutralized, and the brakes set to prevent movement: On or about July 27, 2012, An employee using powered industrial vehicles did not lower the load engaging means and set the brakes during material handling operations in the Mazak tower loading area. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.178(o)(5): The carriage or blades of the industrial truck was not placed under the load as far as possible in order to stabilize the load. On our about July 27, 2012, Material handling operations such as loading the Mazak loading tower with steel plates required employees to use a powered industrial vehicle. The steel plates were not being placed as far as possible on the load engaging means and the mast was not carefully tilted backwards to keep the load stable. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d)
