29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: An employee was exposed to the hazard of being struck in the head by falling materials and tools, and employees were not required to wear hard hats while working underneath employees performing work activities on the roof.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. Employees performing roofing activities were exposed to falling over 9 feet to the ground below and no fall protection was utilized. MASSEY ROOFING, INC WAS PREVIOUSLY CITED FOR VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.501(b)(13), WHICH WAS CONTAINED IN OSHA INPSECTION NUMBER 312886054, CITATION 001, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON 04/20/2009, WITH RESPECT TO A WORKPLACE LOCATED AT 1428 NORTHMOORE, PEORIA, ILLINOIS.
