OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment in a place of employment which were free from recognized hazards that were causing or likely to cause death or serious phyisical harm to employees in that employees were exposed to fractures and crushing injuries due to collision and/or roll-over of the powered industrial truck. Work Site - Seat belts were not worn by employees operating forklifts on rough or uneven surfaces, adjacent to holes and adjacent to vehicular traffic. :
