29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. a) On or about 7/31/12 inside building under renovation at 175 Jefferson Ave., Buffalo, NY: An employee used a DeWalt Abrasive Wheel Cutoff Saw (chop saw) to cut metal studs. The saw was connected to 120-volt ac power via an extension cord which was plugged into a wall receptacle in the building. No GFCI or assured equipment grounding program was being used. NO ABATEMENT CERTIFICATION REQUIRED

The outer sheath of the power cord of the saw was frayed/cut in one spot, exposing the conductors. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers: a) On or about 7/31/12 inside building under renovation at 175 Jefferson Ave., Buffalo, NY: An employee using a DeWalt chop saw to cut metal studs was exposed to the potential of stepping into a nearby shallow, narrow, rectangular floor hole which was left uncovered. This hole was approx. in the center of the building and the length of the hole ran in the north-south direction. The dimensions of the hole were approx. 15 in. wide x 20 ft. long x 12 in. deep. NO ABATEMENT CERTIFICATION REQUIRED
