29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): (a)Quicks Hoe & Landscape Service, Inc., 3606 Decatur St., Denver, CO: On 8/2/12, the employer did not ensure that each employee conducting work in an excavation was protected from cave-ins by an adequate protective system. Employees were hand digging a section of sewer pipe and placing a plug in the incoming line. The trench had vertical walls and was approximately 10 feet deep. This condition exposed the employees to a crushing hazard by excavation wall cave-in. Quicks Hoe & Landscape Service, Inc. was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Administration Standard, 29 CFR 1926.652(a)(1), which was contained in OSHA Inspection number 190334, Citation number 1, Item 1 a issued on February 14, 2012, and became Final Order on March 30, 2012, with respect to a workplace located at 6784 Oneida St., Commerce City, CO.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) Quicks Hoe & Landscape Service, Inc., 3606 Decatur St., Denver, CO: On 8/2/12, the competent person did not remove employees from the hazard of working in an unprotected excavation. Employees were hand digging a section of sewer pipe and placing a plug in the incoming line. The trench had vertical walls and was approximately 10 feet deep. This condition exposed the employees to a crushing hazard by excavation wall cave-in.
