29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    The employer does not ensure employee is protected from falling while working at heights greater than six feet. This violation was observed on or about August 01, 2012, when an employee was exposed to a fall hazard while working on the roof of the one floor structure of a residential being constructed that was 9 feet tall. Employee was wearing a harness but he was not tied off.    Sanchez Sergio was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 329401 Citation Number 1, Item Number 1 and was affirmed as a final order on 5/09/2012, with respect to a workplace located at 3215 Single Ridge Way, Katy, Texas 77449.
