29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: The employer does not ensure employee is protected from falling while working at heights greater than six feet. This violation was observed at the construction site on or about October 29, 2013, when employees were exposed to a fall hazard while working on the roof of the two floor structure of a residential home being constructed without any means of fall protection. Sanchez Sergio was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 329401 Citation Number 1, Item Number 1 and was affirmed as a final order on 5/09/2012, with respect to a workplace located at 3215 Single Ridge Way, Katy, Texas 77449. Sanchez Sergio was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 554060 Citation Number 1, Item Number 1 and was affirmed as a final order on 9/25/2012, with respect to a workplace located at 3303 Single Ridge Way, Katy, Texas 77449. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: The employer does not ensure that ladder used by employee is extended 3 feet above the upper landing surface. This violation was observed at the construction site on or about October 29, 2013, where employees were exposed to a 12 foot fall hazard when using a ladder that was not extended 3 feet above the upper landing.
