29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (1), except as permitted by paragraph (1)(5), prior to permitting an employee to operate a power industrial truck:     This violation occurred on August 10, 2012 and at times prior thereto, in the distribution facility, employees operated Mitsubishi forklifts without first completing training consisting of a combination of formal instruction, practical training, and evaluation of their performance.
