29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    On or about August 8, 2012, an employee who operated a Genie forklift to move building materials had not been trained to operate the equipment safely.  Employees were exposed to a fall hazard at fall distances approximately 18 feet above the ground.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied.    On or about August 8, 2012, an employee worked from a pallet while it was elevated over the roof by a Genie GTH-1056 forklift.  The employee was not provided fall protection and was exposed to a fall hazard.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).    On or about August 8, 2012, employees who were conducting roofing work on a residential structure were exposed to fall hazards approximately 18 feet and higher to the ground below.
