29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:          a) On or about 08/08/12, on construction site at the American Legion Alden Post, 13143 Broadway St.,Alden, NY: Employees exposed to falls while engaged in roofing work on steep & low-slope roofs, and while accessing the roofs using extension ladders were not trained about Osha fall protection regulations, ladder safety regulations, and applicable OSHA regulations pertaining to other hazards that the employees may potentially be exposed to when engaged in roofing work.    ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11):     Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:      a) On or about 08/08/12, on the east side high roof at the American Legion Alden Post, 13143 Broadway St.,Alden, NY: An employee engaged in roofing work & using a hand-held blower was exposed to a fall of approx. 22 ft. because no fall protection system was utilized. The roof pitch was estimated to be approx. 8 in 12.    b) On or about 08/08/12, on the east side dormer roof over the handicap entrance at the American Legion Alden Post, 13143 Broadway St.,Alden, NY: Employees engaged in roofing work were exposed to a fall of approx. 12 ft. because no fall protection system was utilized. The roof pitch was estimated to be approx. 6 in 12.      NO ABATEMENT CERTIFICATION REQUIRED

Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.      a) On or about 08/08/12, on the east side lower roof at the American Legion Alden Post, 13143 Broadway St.,Alden, NY: Employees engaged in roofing work were exposed to a fall of approx. 17 ft. because no fall protection system was utilized. 29 CFR 1926.1053(b)(1):     Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:      a) On or about 08/08/12, at the east side lower roof at the American Legion Alden Post, 13143 Broadway St.,Alden, NY: Employees using an extension ladder to access the roof were exposed to a fall of up to 17 ft. because the siderails of the ladder only extended approx. 1 ft. 4 inches inches above the roof eave.      b) On or about 08/08/12, at the east side dormer roof over the handicap entrance at the American Legion Alden Post, 13143 Broadway St.,Alden, NY: Employees using an extension ladder to access the roof were exposed to a fall of up to 12 ft. because the siderails of the ladder only extended approx. 1 ft. above the roof eave.
