29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a) Along the west side of South Cromartie Street north of McDaniels Road, on or about August 13, 2012, the employer did not ensure that adequate training was provided for an employee who was designated to act as the competent person where employees were performing trenching activities during the installation of an eleven-foot deep pipeline, resulting in engulfment and struck-by hazards.

29 CFR 1926.651(j)(2):     Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) Along the west side of South Cromartie Street north of McDaniels Road, on or about August 13, 2012, an employee was standing in the bottom of an eleven-foot deep trench where the edge of the spoil pile was located between zero and eighteen inches from the east wall of the trench, resulting in a struck-by hazard.

29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:    a) Along the west side of South Cromartie Street north of McDaniels Road, on or about August 13, 2012, an employee was working in the bottom of an unprotected eleven-foot deep trench that had not been inspected by a competent person, creating in an engulfment hazard.    L & L Utilities, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(1), which was contained in OSHA inspection number 310988976, citation number 1, item number 1 and was affirmed as a final order on February 28, 2008, with respect to a workplace located at Highway 80 & Pooler Parkway, Pooler, GA 31322.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):    a) Along the west side of South Cromartie Street north of McDaniels Road, on or about August 13, 2012, adequate cave-in protection was not provided for an employee who was working in the bottom of an eleven-foot deep trench with layered Type B over Type C soil, in that the bottom of the trench was about four feet wide and the top of the trench was about ten feet wide, which resulted in wall sloping that was steeper than 34 degrees; and no other protective systems were being utilized, creating in an engulfment hazard.    L & L Utilities, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 310988976, citation number 2, item number 1 and was affirmed as a final order on February 28, 2008, with respect to a workplace located at Highway 80 & Pooler Parkway, Pooler, GA 31322.
