29 CFR 1904.7(b)(3): The employer did not correctly classify the following work-related injuries or illnesses on the OSHA Form 300 or equivalent. On or about August 16, 2012, the employer did not record the following workplace injuries or illnesses correctly on the OSHA Form 300 or equivalent for the calendar year 2012. (a) On or about March 9, 2012 a recordable injury occurred when an employee tripped over a roll of paper on the loading dock while closing the rear door to a tractor trailer, twisting his left ankle and knee. The employee was placed on restricted duty for 10 days, then was totally disabled for 88 days. Instead of placing a check in column H and the correct number of days in columns K and L, the employer marked column I and 180 days restricted. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1904.33(b)(1): During the five year storage period, the employer did not update the stored OSHA 300 Logs to include newly discovered recordable injuries or illnesses and to show any changes that had occurred in the classification of previously recorded injuries and illnesses. On or about August 16, 2012, the employer had not updated the 2011 OSHA 300 Log to include: (a) On or about September 8, 2011, an employee experienced a groin strain while working and was given restricted duty for 16 days. (b) On or about June 27, 2011, an employee experienced a fractured rib while working and was given restricted duty for 10 days. (c) On or about June 23, 2011, an employee was struck by a load that fell off a fork lift and was given restricted duty for 20 days. (d) On or about February 22, 2011, an employee was struck in the eye while working and was given prescription medication. (e) On or about February 8, 2011, an employee experienced a rotator cuff tear while working and was given 180 days away from work. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET)
