29 CFR 1926.451(g)(4)(iv): When midrails are used, they shall be installed at a height approximately midway between the top edge of the guardrail system and the platform surface. a) On or about August 14, 2012; East chimney area, employees were working off a scaffold system in which not mid-rail were installed to prevent the employees from falling 38 feet to ground level.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows: a) On or about August 14, 2012; Eastside ground scaffold; the working platform used to bring the working materials to the employees on the chimney scaffold was not fully planked exposing the employees to an 18 foot fall to ground level.

29 CFR 1926.451(g)(1)(v): Each employee on a walkway located within a scaffold shall be protected by a guardrail system (with minimum 200 pound toprail capacity) installed within 9 1/2 inches (24.1 cm) of and along at least one side of the walkway. a) On or about August 14, 2012; scaffold located at eastside of home; the employer had not installed a railling system for those employees accessing the center walkway platform area which is used to travel between the two scaffold systems; exposing employees to a 13-15 foot fall to ground level.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access. a) On or about August 14, 2012; eastside of site; employees were using the scaffold frame to access the working platforms.
