29 CFR 1910.147(c)(1):     The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative      a)  production area, on or about August 15, 2012, an energy control program (lockout/tag-out) consisting of machine specific lockout/tagout procedures, training, and periodic inspections had not been developed for employees to utilize when performing servicing and maintenance on machines such as, but not limited to, the Toledo and Bliss presses and the table saws.

29 CFR 1910.212(a)(3)(ii):     The point of operation guarding device was not in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, was not so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle:    a)  production area, on or about August 15, 2012, the Toledo press, which is used to make the plastic parts for the baskets, had a guard with openings on both sides to insert the plastic strip.  The openings did not prevent the entry of hands or fingers into the point of operation by reaching through, over, under or around the guard.       b)  production area, on or about August 15, 2012, the guard on the Toledo press, which is used to cut out plastic parts for the baskets, was not constructed to conform with any appropriate standards or designed to prevent the operator from having his hands and/or fingers in the danger zone while it is operating.
