29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b): a) First level of the structure located at 312 Eastgate Drive, Prattville, AL: On or about August 15, 2012, the employer did not ensure a fall protection method was available, provided, and/or used to protect employee(s) walking and/or working on the top plates which exposed employees to falls up to 12-feet to the concrete slab or unfinished ground below. b) Second level of the structure located at 306 Eastgate Drive, Prattville, AL: On or about August 15, 2012, the employer did not ensure a fall protection method was available, provided, and/or used to protect employees from the unprotected edge of the second level flooring near the top of the stairs which exposed employees to a fall of 11-feet to the concrete slab below. c) Second level of the structure located at 306 Eastgate Drive, Prattville, AL: On or about August 15, 2012, the employer did not ensure a fall protection method was available, provided, and/or used at the wall openings (windows) which exposed employees to a falls up to 13-feet to the unfinished ground below.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever was less, were not equipped with one stairrail system along each unprotected side or edge: a) Stairway in between first and second floors of the structure located at 306 Eastgate Drive, Prattville, AL: On or about August 15, 2012, the employer did not ensure the open side of the stairs in between the 1st and 2nd levels was protected by a stair rail system or other equivalent fall protection method which exposed employees to falls up to 11-feet to the concrete slab below.
