OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees while operating forklifts without using seatbelts in the facility:    a)  At Daiel USA Corp:  On or about August 14, 2012 and at times prior; the employer exposed his employees to struck-by hazards in that he allowed employees to operate forklifts without wearing a seatbelt.

29 CFR 1910.147(d)(4)(i):   Lockout or tagout devices were not affixed to each energy isolating device by authorized employees:    a) At the UDA Number 1 Line:  On or about August 14, 2012 and at times prior; authorized employees were exposed to struck-by, caught-in and amputation hazards when entering the robotics area of the UDA number 1 line without deenergizing the hazardous energy sources.

29 CFR 1910.305(b)(1):  Unused openings in boxes, cabinets, or fittings were not effectively closed:    a)  At Panel 5 on the North Wall of the Production Area:  On or about August 14, 2012 and at times prior; the employer failed to ensure an opening not in use at Breaker Panel number 5 was properly covered exposing employees to fire hazards.
