OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to impalement hazards while walking and working near threaded steel rods protruding up from the foundation walls. Jobsite: While finishing/smoothing the poured concrete floors, employees were exposed to impalement hazards from threaded anchor rods protruding from the concrete foundation.

Jobsite: Employees walking/working along the unprotected sides and edges of the concrete floor were exposed to falling approximately 8.4 feet to the basement floor.
