29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b):    A. On or about August 20, 2012, the employer failed to ensure employees working from a 6/12 pitch roof were protected from a fall of approximately 18 feet 7 inches by using an adequate fall protective system/devices. Employees were performing tear off and replacement of weatherproofing from a residential roof.     B. On or about August 20, 2012, the employer failed to ensure employees working from a 4/12 pitch roof were protected from a fall of approximately 10 feet 3 inches by using an adequate fall protective system/devices. Employees were performing tear off and replacement of weatherproofing from a residential roof.     LINDSEY CONSTRUCTION & DESIGN, INC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.501(B)(13), WHICH WS CONTAINED IN OSHA INSPECTION NUMBER 313671943, CITATION NUMBER 02, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 9, 2009, WITH RESPECT TO A WORKPLACE LOCATED AT 20296 EMERY ROAD, CLEVELAND, OH 44128.
