29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. a. Inside trailer trucks/Dock Area - On or about August 23, 2012, employees were required to load and unload trailer trucks while operating propane fork lift trucks that were poorly maintained. The conditions of the fork lift trucks were the following; 1. The Toyota fork lift truck with ID # 9342176 (Serial # 39568 and Model # 8FGCU20) had a carbon monoxide level of 1.92 % while idling. 2. The Toyota fork lift truck with ID # 9347239 (Serial # 12130 and Model # 8FGCU20) had a carbon monoxide level of 2.89 % while idling. 3. The Toyota fork lift truck with ID # 9341481 (Serial # 33373 and Model # 8FGCU20) had a carbon monoxide level of 2.27 % while idling.

29 CFR 1910.178(l)(3): Training program content. Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace. a. Dock Area/Inside truck's trailers - On or about August 23, 2012, employees were required to operate propane powered fork lift trucks and had not received training on truck-related and workplace-related topics. The topics missing on the training were the following; 1. Operating instructions, safety warnings, and precautions for the types of trucks. 2. Closed environments and other areas were insufficient ventilation or poor vehicle maintenance could cause a buildup of carbon monoxide or diesel exhaust.

Dock Central Area/Distpacher Office - On or about August 23, 2012, employees were required to operate propane powered fork lift trucks that had some of their "safety warning decals" maintained in a not clear and legible condition. The fork lift trucks and their specific conditions were the following; 1. The Toyota fork lif truck with ID # 9345273 (Serial # 94006 and Model # 7FGCU20) had its mast's safety warning decal unclear. 2. The Toyota fork lift truck with ID # 9347192 (Serial # 11683 and Model # 8FGCU20) had its mast's safety warning decal unclear. 3. The Toyota fork lift truck with ID # 9346059 (Serial # 98593 and Model # 7FGCU20) had its mast's safety warning decal unclear. 4. The Toyota fork lift truck with ID # 9341268 (Serial # 31723 and Model # 7FGCU20) had its mast's safety warning decal unclear. 5. The Toyota fork lift truck with ID # 9349171 (Serial # 25258 and Model # 8FGCU20) had its counterweight's safety warning decal unclear.
