29 CFR 1926.501(b)(10):     Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.    a) Jobsite; 437 Chestnut Street, North Portico Roof - On or about 8/23/2012, an employee installing flashing on the north portico roof was exposed to a fall hazard of approximately 40 feet to the ground without fall protection.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.453(b)(2)(iv):     Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position.    a) Jobsite - 437 Chestnut Street, North Portico, Aerial Lift - On or about 8/23/2012, an employee performing flashing work approximately 40 feet above ground from a JLG aerial lift climbed on and over the basket to access the portico roof.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.453(b)(2)(v):     A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).    a) Jobsite: 437 Chestnut Street, North Portico, Aerial Lift - On or about 8/23/2012, an employee performing flashing work approximately 40 feet above ground from an articulated JLG aerial lift was not wearing a body belt with lanyard or a harness with lanyard attached to the boom or basket.     Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
