OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employee(s) were exposed to fall & struck-by hazard(s) due to upward tilt / pivot of the work platform on the forks of a variable reach rough-terrain forklift used to lift people to / from the roof of a structure being demolished. a) 614 So. Broad Street in Elizabeth, NJ: Employee(s) riding in a job-made work platform lifted on the forks of a rough-terrain telehandler (Ingersoll Rand VR-1056) for access to & from the roof of a two-story building undergoing demolition were exposed to falls between 6 and 20 feet in the event of upward pivot of the carriage and/or forks from contacting an obstruction while lowering the work platform. Condition(s) were noted on or about 8/22/2012. NOTE: Among the feasible and acceptable methods to abate the hazard is to provide safe access to the roof through the use of an approved personnel (aerial) lift; or through use of conventional ladder of appropriate length and secured against displacement.

Broad Street in Elizabeth NJ without any guardrails, personal fall arrest system(s), or other means of protection from falls of 20 ft to the ground below. Condition(s) were noted on or about 8/22/2012.
